These Terms and Conditions ("Terms") govern your use of the website, client portal, and services provided by Medica Specialty Risk LLC ("Medica Risk," "we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By accessing or using the Medica Risk website at medicarisk.com, creating a client portal account, or engaging our insurance brokerage services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all visitors, users, clients, and any other persons who access or use our services.

2. Our Services

Medica Risk is a licensed insurance agency specializing in coverage placement for medical spas and aesthetic medicine practices. Our services include:

  • Insurance needs assessment and coverage gap analysis
  • Solicitation and placement of insurance policies through licensed carriers and surplus lines markets
  • Policy management, renewal coordination, and endorsement processing
  • Claims advocacy and guidance
  • Access to a client portal for policy management

3. We Are Not an Insurer

Medica Risk acts as your insurance agent and broker. We are not an insurance company and do not underwrite, guarantee, or directly provide insurance coverage. All policies are issued by third-party insurance carriers, and coverage is subject to each carrier's terms, conditions, exclusions, and claims-handling procedures.

We exercise professional care in recommending coverage and selecting carriers, but we do not guarantee the financial solvency of any insurer or the outcome of any claim. Binding authority, where we hold it, is exercised on behalf of and subject to the terms of the applicable carrier.

4. Client Portal

Account Security

If you create a client portal account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Acceptable Use

You agree to use the client portal only for its intended purpose — managing your insurance policies, viewing documents, and communicating with our team. You may not:

  • Attempt to gain unauthorized access to any part of the portal or its underlying systems
  • Use the portal in any manner that could damage, disable, or impair its functionality
  • Upload malicious code or content
  • Share your login credentials with unauthorized individuals

Termination of Access

We reserve the right to suspend or terminate your portal access at any time if we reasonably believe you have violated these Terms or if your client relationship with Medica Risk ends.

5. Accuracy of Information

You agree to provide accurate, current, and complete information when applying for insurance, requesting quotes, or using our services. Inaccurate or incomplete information may result in coverage being voided, claims being denied, or policies being cancelled by the issuing carrier. Medica Risk is not liable for consequences arising from information you provide that is false, misleading, or incomplete.

6. Intellectual Property

All content on the Medica Risk website — including text, graphics, logos, icons, images, software, and design elements — is the property of Medica Specialty Risk LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any of our content without prior written consent.

7. Disclaimers

The information on our website is provided for general informational purposes only and does not constitute insurance, legal, financial, or professional advice. While we strive to keep content accurate and up to date, we make no warranties or representations about the completeness, accuracy, or reliability of any information on our site.

Our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Medica Specialty Risk LLC, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website or services, including but not limited to loss of profits, data, or business opportunities.

Our total aggregate liability for any claims arising from or related to these Terms or our services shall not exceed the total fees paid by you to Medica Risk during the twelve (12) months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Medica Specialty Risk LLC, its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of our services, or your provision of inaccurate information in connection with insurance applications or claims.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or our services shall be resolved in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated effective date. For material changes, we will make reasonable efforts to notify you via email or a prominent notice on our site. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
